SOPARTEC takes care to exercise its activities in the respect of your privacy, in particular with regard to the treatment of your personal data.

These rules (the "Rules") explain how, in what ways and for what reasons we collect and use your data. We also indicate the rights you have in connection with the processing of your personal data, and how you can exercise them.

SOPARTEC processes your personal data in accordance with the applicable data protection legislation, which includes the General General Data Protection Regulation (Regulation 2016/679) ("GDPR") and the national data protection laws, including the law of 30th of July 2018 on the protection of individuals with regard to the processing of personal data.

  1. Who are these Rules for?

These Rules are for the following categories of persons:

  • visitors to the websites http://www.sopartec.com/ and http://www.vivesfunds.com/, the latter presenting the activities of the Vives investment funds (the "VIVES Funds"), which are managed by SOPARTEC ;
  • people who contact us via the aforementioned websites;
  • people who wish to apply for a job;
  • persons entering into contractual relations with SOPARTEC and / or the VIVES Funds.
  1. What personal data does SOPARTEC collect and process?

These Rules apply only to "personal data" within the meaning of the GDPR.

By "personal data" we mean data relating to an identified or identifiable person, whether directly or indirectly and (i) that you provide to us or (ii) that is generated by your use of our services or your activity on our sites.

So:

  1. We collect the personal data that you have submitted to us through a contact through our "Contact Us" contact forms, such as basic identification data (last name, first name and email address) and optionally, your function, company, address, phone and / or fax number. We gather information about the profession you practice to offer a service tailored to your specific needs.
  2. If you are applying for a position with SOPARTEC, we collect your credentials and your curriculum vitae.  
  3. In order to disseminate information about our activities, we also process the data obtained from the address books of our employees or via the LinkedIn social network. If you wish to know the collaborator who has given us your personal data, please contact us at the email address mentioned above.
  4. When you visit our websites, we collect the following information:
    1. the IP address assigned to you when you login;
    2. the date and time of access to the site;
    3. the pages consulted;
    4. the type of browser used;
    5. the platform and / or operating system installed on your computer;
    6. the search engine and the keywords used to find the site;
    7. your search preferences for certain types of information, which will save you from having to repeat the same keyboard entries each time you visit our sites;

This information is collected using cookies whose functioning is explained in point 8.  

  1. Purposes of the collection and processing of personal data

Data provided to, or collected by SOPARTEC, are only processed for the following purposes:

  • Measure the number of visitors in the different sections of the sites and improve the use of our sites as efficiently and comfortably as possible;
  • Track messages sent by website visitors via our "Contact Us" contact forms;
  • Follow up on applications for a job;
  • Disseminate information on the activities of SOPARTEC and / or VIVES Funds (newsletters), SOPARTEC having a legitimate interest in promoting these activities to people who have come into contact with it or the VIVES Funds, who have shown an interest in these activities, the sending of targeted advertising by mail is carried out with the prior consent of the person concerned, unless it is already contractually bound to SOPARTEC or VIVES Funds.
  1. Who can your data be shared with?

As a rule, the personal data that we collect via our sites or in the context of contracts concluded between us, are intended for our exclusive use.

However, SOPARTEC reserves the right to entrust the hosting or processing of your personal data to subcontractors who have all the guarantees of reliability and security and with whom SOPARTEC has entered into a confidentiality agreement.

These subcontractors or service providers we use may only process your data in accordance with the instructions we give them and in accordance with these Rules.

We may also transfer your personal data to public authorities or other third parties where required by law.

Apart from these assumptions, SOPARTEC does not communicate any personal data, anonymized or not, to third parties.

  1. How long do we keep your data?

In general, your data are kept by us for 2 years from the last exchanges and subject to the use of your rights as detailed in point 7.

However, if a contract is signed between us, your data will be kept by us for the period of time necessary to fulfill the contract or the follow-up of the relationship or for archiving, financial management, or to enable us to, if necessary, assert our rights in court, in the context of a dispute from your part or from a third party in connection with your contract.

  1. What are your rights regarding the process of your personal data?

As a person concerned by the processing of personal data, you may exercise the following rights in connection with your data:

Access right:

As a user of sites with an account, you have direct access to some of your personal data such as last name, first name, email, billing addresses and delivery.

When permitted by law, you may require SOPARTEC to obtain confirmation from SOPARTEC that data about you is being processed by SOPARTEC, and if so, to have access to it. A request for possible access will only be granted if SOPARTEC is able, on the basis of the information in its possession, to identify you with certainty.

Notwithstanding the above, any request for access to your data must be accompanied by a copy of your identity card.

SOPARTEC has 30 days to respond to your request, this period beginning once SOPARTEC is in possession of all the information required to satisfy your request.

Rectification right:

You may require SOPARTEC to rectify incomplete or inaccurate data about you without charge.

Right to withdraw your consent:

When allowed by law, you may notify SOPARTEC that you withdraw your consent to the use by it of the identification or contact data that you spontaneously transmitted to it as part of your visit to its websites, being specified that the withdrawal of your consent will not affect the regularity of the treatments carried out prior to this withdrawal.

Cancellation right:

You have the right to request the deletion of your personal data when:

  • they are no longer necessary for the fulfilment of the purposes for which they were collected or processed;
  • the treatment was based solely on your consent and you withdraw your consent;
  • the preservation is not or no longer required under the contract or a legal obligation to which SOPARTEC or the VIVES Funds are subject;

Opposition right:

You always have the right to object to the use of your personal data for direct marketing purposes without giving any reason and without charge.

You can unsubscribe at any time newsletters addressed to you by sending us a request to this effect to the address: info@sopartec.com.

Appeal in case of complaint:

If you feel that your rights in connection with the treatment you are subject to are not respected by SOPARTEC, you can submit a complaint to the following address: info@sopartec.com or, if it is not managed in a satisfactory manner, to the Data Protection Authority (www.autoriteprotectiondonnees.be - formerly the Belgian Commission for the Protection of Privacy).

  1. The use of cookies

a. Definition

We use cookies to obtain certain usage information from our websites in accordance with Article 129 of the Electronic Communications Act of 13 June 2005 and the ePrivacy Directive 2002/58.

A cookie is a small text file that a website transfers to the hard drive of your computer through your web browser to allow the website to recognize your browser and retain certain information.

b. The cookies we place on your device

When you visit the websites of SOPARTEC and VIVES funds, a pop-up message appears to notify you of the use of cookies.

Concretely, we use the following cookies:

  • Strictly necessary cookies: These are the cookies used to navigate or provide a service requested by the user. They are not used for other purposes and these cookies are deleted when you close your browser (so-called "session cookies").
  • Trackers: These are cookies that show how many people visit a site and collect information about the device you use.
  • Cookies used for tracking: These are the cookies used to track the user's online browsing on a website.

In particular, these cookies allow us to collect the following data:

Cookies do not contain information that allows you to contact you by phone, email or post.

c. Purposes

The use of cookies allows us to measure the number of visitors in the various sections of the sites and to make our sites more user-friendly by saving, for example, your username and password, your language, your search preferences. They also enable us to understand how websites are used, what elements of sites are visited and how often in view of improving them.

d. Your rights to accept and manage cookies

By using our websites, you consent to the use we make of cookies.

Cookies are kept for the time necessary to fulfil the purpose pursued. In general, they are kept until you delete cookies from your browser.
